From its inception, the Electoral College has been one of the most controversial features of the Constitution. In his presentation, Professor Robert Alexander examines how the body came into being and how it has changed over time - paying particular attention to how recent elections have brought increased attention to the Electoral College and its processes after the general election. Findings from surveys of presidential electors over the last two decades has led him to express deep concerns about the potential harm “faithless electors” could cause. While the Supreme Court took up this issue in 2020, they did not eliminate their possibility. Further, the events surrounding the January 6th counting of electoral votes has created an urgent need to remove ambiguities in this process.
